I’ve been stolen – سرقة عيني عينك : Part 1

Story in Brief: A friend of mine started a facebook group that he called -OMG! I’m so awesome-, it was a support group to those who are great, but always under appreciated. He came up with a funny logo and used it, I decided to make an Arabic version of the quote (this was 3 months ago if not more). However, this particular friend of mine is moody, 3 months later he shut the page down, and guess what… today by total coincidence, I saw my design stolen and printed on hoodies and even sold by someone on facebook. The person who stole it, did a live “trace” on illustrator and it even shows the low quality process because of the dots of the “ي” character in Arabic.

What can I possibly do guys? please advice… he is making money out of it, sold hoodies already.

صديق من اصدقائي بدأ صفحة على الفيسبوك وسماها يا إلهي شو اني آوسوم وكان إلها شعار حلو بالانجليزي فأنا رحت عملت للصفحة لوجو عربي ،وحتى عملت مزيج غنائي بدون توقف وسميتو باسم هالصفحة… بس صاحبي هاد مزاجي شوي وبيوم من الايام وقف الفيسبوك… بعد ٣ اشهر ولا بالصدفة بنعملي انفايت على صفحة واحد بيبيع بلايز شتوية وعامل تصميمي عليها… وعشان يبين السرقة فهو عامل حركة ببرنامج الالستريتور بتشف التصميم بس مو دقيقة، لاحظو زوايا التصميم المطبوع وكيف نقط حرف الياء مش مستديرة.

شو اعمل؟ اروع بالملف الاساسي اللي عليه تاريخ الملف عالمحامي؟

  1. I don’t what to say Moe because this is going to be hard to deal with in Jordan! I don’t know if there is a law to protect property but you have to ask a lawyer to get an answer.

    Moey I don’t think there is much to do if the logo is not copyrighted. Even if you went ahead an did the copyright now, not much will be done as the shirts were created before the copyright date. But it should stop him selling your logo. I know this sucks. Sorry.

    Unfortunately there is no respect to art in the Middle East; there are no laws and copyrighting everything is not a solution. I found my photographs stolen and put on commercial websites recently.

    If you know who the guy is, run him over!

    Man, before you do any design and head online with it Copyright it. Then you’ll be able to sue whoever steals your designs. Sorry to hear of what happened but you should be more careful in the future. People tend to steal from others specially when they’re good and they know they’re stuff isn’t copyrighted.

    Hey Moey, before you actually refer to a lawyer make sure he understands the “laws of the internet” because as I said earlier, Facebook’s TOS ensure that you no longer have copyright over things you post on their site, and therefore it can be distributed freely without you being consulted. You’d be lucky if you find a loophole for this.
    Another thing, since its a digital file, it’s going to be hard proving ownership. The “thief” could claim that you stole it from him and posted it on facebook. Courts do not really understand technology that much, and your issue of resolution and pixilation may be disregarded because of lack of knowledge.
    So make sure you get a “techy” lawyer if you want to go through with this.

    This actually happened to me once and I emailed the guy who then sent an apology email and put my name on the credit of the original design, which is all I wanted since all the money from every t-shirt sold was going to charity.
